BuildVision Terms of Service

These Terms of Service ("Terms") govern your use of the BuildVision mobile application (the "App") and the related backend services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

BuildVision lets contractors and homeowners visualize accessory dwelling units (ADUs) on their own property by combining a photo of a lot with a curated brochure ADU style. The output is an AI-generated photorealistic preview, not an architectural drawing or engineering plan. The Service is for visualization and sales purposes only — it is NOT a substitute for professional architectural, structural, or zoning advice.

2. Your Account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You're responsible for keeping your password secure. Notify us immediately if you suspect unauthorized access.
• You agree to provide accurate information when signing up and to keep it current.
• One account per person. Don't share login credentials.

3. Acceptable Use

You may use BuildVision to generate ADU previews of properties you own, manage, or are working on as a licensed contractor. You agree NOT to:

• Upload photos of properties you have no right to photograph or modify.
• Upload photos depicting illegal content, including but not limited to: photos taken without consent of identifiable people, copyrighted material you don't own, or content that violates anyone's privacy.
• Use the Service to create renderings intended to defraud, mislead, or misrepresent property — including any rendering you intend to share with a buyer/tenant/regulator as if it depicted a real existing structure.
• Reverse-engineer, decompile, or otherwise probe the Service's internals beyond fair-use security research.
• Use automated tools to mass-generate images, scrape data, or load-test the Service.
• Resell, sublicense, or otherwise commercialize the Service or its output beyond your own contracting business.

We may suspend or terminate accounts that violate these rules without prior notice.

4. AI-Generated Content

BuildVision uses AI models to produce visualizations. You are responsible for reviewing each output for accuracy before sharing it with clients, regulators, or anyone else. AI-generated images can contain artifacts, inaccuracies, or scale errors that aren't appropriate for legal, planning, or construction use.

• Ownership: you retain ownership of any images you upload to the Service. You also own the AI-generated outputs derived from your photos, subject to the AI provider terms (Google Gemini, fal.ai) which apply to their respective contributions.
• License to us: you grant BuildVision a limited, non-exclusive, royalty-free license to process your uploaded photos solely to provide the Service to you. We do not use your content to train AI models or for any other purpose.
• No exclusivity guarantee: because AI generation is probabilistic, two users uploading similar photos and selecting similar styles may receive similar outputs. We don't guarantee uniqueness.
• Brochure references: the curated ADU style brochures shown in the Service are for inspiration. The actual generated output may differ from the reference image.

5. Branding & Watermarks

When you set a business name, phone number, or logo in Settings, the Service composites those onto images you save or share. You're responsible for ensuring you have the right to use any logo or business identifier you upload. The "Powered by BuildVision" footer is a small attribution we ask you to leave on shared images.

6. Subscriptions and Payments

If we add paid tiers in the future, additional terms will apply specific to those tiers (free trial duration, refund policy, automatic renewal, etc.). Payment is processed by Apple via the App Store and is subject to Apple's terms. Currently, BuildVision is free to use during this beta.

7. Service Availability

We aim for high availability but make no specific uptime promise. The Service may be unavailable for maintenance, updates, third-party outages (Google AI, fal.ai, etc.), or unforeseen reasons. Generated images may take up to a few minutes during busy periods.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT GENERATED IMAGES WILL BE ACCURATE, COMPLETE, RELIABLE, FIT FOR ANY PURPOSE, OR FREE FROM ERROR. YOU USE GENERATED IMAGES AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDVISION AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST BUSINESS, LOST CLIENTS, OR DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE OR FROM ANY GENERATED CONTENT — EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless BuildVision and its operators from any claim arising from: (a) your use of the Service in violation of these Terms; (b) content you upload that violates someone's rights; or (c) your sharing of generated images in a way that misleads or harms a third party.

11. Termination

You can stop using the Service at any time by deleting your account (see Privacy Policy Section 5). We can suspend or terminate your account if you violate these Terms or applicable law. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive (Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive termination.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction. If you live in the EU/UK, applicable consumer-protection laws of your country of residence may also apply.

13. Changes to These Terms

We may update these Terms occasionally. The "Last Updated" date reflects the most recent change. Material changes will be communicated in the App or by email at least 30 days before they take effect. Continuing to use the Service after a change means you accept the updated Terms.
